Protection or Punishment? Should we fix the message of our legal system?
Please bring back “protection intent” and not punishment in law. This may seem a small or even moot point but the physiological damaging implications are immense.
Men are not hanged for stealing horses, but that horses may not be stolen – George Savile…
The message of protection…no one has the right to harm another person. And society has the right to protect itself from you if you prove to be a danger. Punishment does not send this message. Let me explain further why this is so important.
As with most everything today, we have twisted and perverted everything so badly that nothing makes sense to us anymore. Punishment is wrong…because it does not work! Is that not obvious to all of us by now? But what is the most devastating issue with punishment is that it is sending the wrong message to society.
Sadly, until man develops a true intellect we will continue to have cave man like problems in the world. Rape, murder, war, genocide, bigotry, hate on and on. So of course society has not only a right but an obligation to protect itself. PROTECT…not punish.
I think punishment was established to give power to the government and the courts to take away the power of the people. The message of government punishment makes criminals and society as a whole subservient and fearful of the Elite…not of the people who are truly the power of Tort laws and our courts of justice.
We can’t punish for murder. Death is not a punishment. What a person does, does not give someone authority to do the same thing. However, if a person or even a dog, has proven itself to be a dangerous liability to society then protection must be enacted, not punishment.
Most people feel that if they can get away with something then it’s all good. If they can avoid the punishment they got away with it. The harm they cause is irrelevant to them. And I realize this is impart because that is the message we are sending today.
Even with our children…punishing them for an action or inaction sends the wrong message. They got caught and will now be punished. Creating a fear of the parent is psychologically damaging. It takes away from the responsibility of the kids actions.
Explaining to a child or a criminal that they ARE NOT BEING PUNISHED…sends a much clearer picture to them; that the responsibility for their actions lays completely on their shoulders. That they DO NOT have the right to harm others in any way shape or form.
The message of protection has a powerful social message attached to it.
Punishment does not.
Punishment simply makes a child or criminal angry at the system or parent. It does not send the message that harmful actions against people…not against laws…are the reason society is being “forced” to take action. We use to call it “rehabilitation” now it is simply going to jail. The message has been lost.
I know this is an issue that needs to be addressed and is hard to realize as Truth.
A small example: If a dog proves to be a danger we put the dog down. Is that punishment?
Sadly, when a person becomes derange and kills…do we punish him with death? NO…we protect society by being forced to deal with a very dangerous and real problem.
I think that this is the message that should be sent for any infraction from petty theft to a traffic ticket.
Even with war. We don’t have a right to persecute over ideology and belief. But we do have the right to protect ourselves, if the ideology proves itself to be world Supremest, bigoted, racism and genocidal war mongering even if they call it a great religion.
It’s not about religion. It is about the dangerous belief entitlements of the religious.
